These Terms of Service govern the use of this website and the purchase of digital products and digital services from [legal/business name] (“we”, “us”, “our”).

By accessing this website, placing an order, purchasing a digital product, booking a service, or submitting information through this website, you agree to these Terms of Service, our Privacy & Cookie Policy, and our Return Policy.

If you do not agree with these Terms, please do not use this website or purchase from it.

2. Products and Services

This website offers:

  • digital print files and downloadable design products;

  • digital creative services, including the Visual Clarity Check;

  • other design, art direction, branding, or visual communication services, where clearly stated.

All products and services are described on the relevant product or service page.

We reserve the right to update, modify, remove, or discontinue any product or service at any time.

3. Digital Products

Digital print products are supplied as downloadable digital files.

No physical product will be shipped unless explicitly stated on the product page.

The file format, size, resolution, dimensions, and any other relevant specifications are described on the product page. Customers are responsible for reviewing all product details before purchase.

After successful payment, the customer will receive access to the digital file through a download link and/or email confirmation.

4. License for Digital Prints

Unless otherwise stated on the product page or agreed in writing, the purchase of a digital print grants the customer a non-exclusive, non-transferable license to use the purchased design for personal or commercial production of physical products and related brand materials.

This means that the customer may use the purchased digital print to create physical products, samples, textile pieces, printed materials, or other approved physical applications.

The purchase does not transfer copyright ownership, exclusive rights, authorship, trademark rights, or intellectual property ownership.

All digital prints, artworks, patterns, illustrations, files, and visual materials remain the intellectual property of [legal/business name], unless a separate written agreement states otherwise.

5. Restrictions on Digital Products

Customers may not:

  • resell, redistribute, share, sublicense, or give away the digital file;

  • upload the file to stock platforms, marketplaces, file-sharing platforms, or template libraries;

  • sell the file as a standalone digital product;

  • claim the design as their own original work;

  • copy, reproduce, or modify the design for the purpose of creating a competing digital product;

  • use the design in a way that is illegal, misleading, defamatory, offensive, or harmful;

  • register the design, or any part of it, as a trademark or exclusive intellectual property without written permission.

Exclusive rights, copyright transfer, custom adaptations, or extended licensing require a separate written agreement.

6. Production Responsibility

Colors, scale, texture, and visual appearance may vary depending on screens, printers, fabrics, inks, production methods, materials, and third-party manufacturers.

Customers are responsible for testing the file before large-scale production.

We are not responsible for production errors caused by third-party printers, manufacturers, software limitations, incorrect file handling, color calibration issues, material differences, or failure to test the design before production.

7. Visual Clarity Check

The Visual Clarity Check is a digital creative service delivered as a written audit/report.

The service is based on the materials provided by the customer, such as website links, social media profiles, brand visuals, screenshots, product images, or other relevant visual materials.

Unless otherwise stated on the service page, the Visual Clarity Check / Visual Audit does not include:

  • redesign;

  • full brand strategy;

  • full art direction system;

  • implementation of recommendations;

  • revisions;

  • consulting calls;

  • ongoing support;

  • creation of new visual assets.

The customer is responsible for providing accurate, complete, and accessible materials. Delivery timelines begin once all required materials have been received.

The audit/report will be delivered within 7 business days after receiving all required materials.

Creative recommendations are based on professional visual analysis and do not guarantee specific commercial, marketing, sales, financial, or audience growth results.

8. Customer Materials

By submitting materials for a Visual Clarity Check / Visual Audit or another service, the customer confirms that they have the right to share those materials with us.

Customer materials will be used only to provide the purchased service, unless the customer gives separate permission for portfolio, marketing, educational, or public use.

We do not publicly share client materials without permission.

9. Orders and Payments

All prices are shown in the currency displayed at checkout.

Payment must be completed before access to digital products or digital services is provided.

Orders are processed through the payment methods available at checkout.

We reserve the right to refuse or cancel an order if there is an error in pricing, product information, payment processing, or suspected misuse of the website.

10. Taxes and Invoices

Prices may include or exclude applicable taxes depending on the website settings, customer location, and applicable law.

Where required, taxes will be displayed at checkout.

Customers are responsible for providing accurate billing information.

If you need an invoice, please contact us at [email address] with the required billing details.

11. Delivery

Digital products are delivered electronically through a download link and/or email confirmation after successful payment.

Digital services are delivered electronically by email, PDF, shared document, or another agreed digital format.

If you do not receive your digital file, download link, or service delivery within the stated timeframe, please contact us at [email address].

12. Right of Withdrawal, Cancellations, and Refunds

Consumers in the European Union generally have a 14-day right of withdrawal for distance contracts, subject to legal exceptions.

Digital products

Due to the digital nature of downloadable products, all sales are final once the download link has been made available or the file has been accessed, provided that the customer has expressly consented to immediate access to the digital content and acknowledged the loss of the right of withdrawal.

Refunds are not provided for accidental purchases, change of mind, incorrect use of the file, compatibility issues with third-party software, or color differences between screens, printers, fabrics, materials, and production methods.

If there is a technical issue with the file or download link, please contact us at support@dashamink.com within 7 days of purchase. We will review the issue and provide a replacement file where appropriate.

Digital services

For digital services, including the Visual Clarity Check, the customer may request cancellation within 14 days of purchase if the service has not yet started.

If the customer expressly requests that the service begins before the end of the 14-day withdrawal period, the customer acknowledges that once the service has been fully performed and delivered, the right of withdrawal is lost and the purchase becomes non-refundable.

If the service has already started but has not yet been fully performed, any refund request may be assessed based on the work already completed.

This section does not affect any mandatory consumer rights that may apply by law.
